Tender Notice

哥倫比亞波哥大地鐵一號線項目擬對項目自動售檢票系統（詳見招標設備清單）進行招標，招標編號：METRO1/TEN/M&E/2022/0002。誠邀市場業績和商業信譽良好且符合投標資格要求的企業參與本次招投標，本次招標采用電子化招標投標方式。
The Bogota Metro Line 1 project in Colombia intends to bid for the Toll/Access Control (PEA) System of the project (see the list of bidding equipment for details). The bidding number is METRO1/TEN/M&E/2022/0002. Companies with good market performance and business reputation and meeting the bidding eligibility requirements are sincerely invited to participate in this bidding. This bidding will be in the method of electronic bidding.

1.招標文件發放時間：2022年3月5日至2022年3月15日（北京時間）。
Bidding document issuance time: March 5th, 2022 to March 15th, 2022 (Beijing time).
2.招標文件發放方式：通過中國交建供應鏈管理信息系統（

http://empm.ccccltd.cn/PMS）以公開招標的方式發放。
The method of issuing the bidding documents: through the Supply Chain Management System of CCCC ( http://empm.ccccltd.cn/PMS), it will be issued by public bidding.
3.投標文件遞交截止時間：2022年04月06日08:00 （北京時間）。
Deadline for submission of bidding documents: 08:00 on April 6th, 2022 (Beijing time).
4.投標文件遞交地點：
(1) 按規定將電子版投標文件上傳至中國交建供應鏈管理信息系統；
Place of submission of tender documents:
(1) Upload the electronic bidding documents to the CCCC Supply Chain Management Information System as required;
5.開標地點：中國交建供應鏈管理信息系統
Bid opening location: CCCC Supply Chain Management Information System.
6.開標時間：投標截止日當日在中國交建供應鏈管理信息系統（ http://empm.ccccltd.cn/PMS）上開標，招標人有權推遲開標。
Bid opening time: Bids will be opened on the CCCC Supply Chain Management Information System ( http://empm.ccccltd.cn/PMS) on the closing date of bidding, and the tenderer has the right to postpone the opening of the bids.
7.投標人資質要求:
Qualification requirements for bidders:
Bidders should be legal persons registered in People’s Republic of China, Republic of Colombia or a third country, whose corporate purpose matches with the purpose of this Tender process, who are not involved in any conflict of interest under the terms established by the Tenderer, and that have experience, knowledge, and capacity to present the proposal and to celebrate and perform the contract.
投標人應是在中華人民共和國境內，哥倫比亞共和國境內或第三國注冊的法人，其公司經營業務與滿足本次招標要求，在招標人制定的條款下不涉及任何利益沖突，并且有經驗、知識和能力提交投標書以及履行合同。
The Bidders shall be the manufacturer that meets all the requirements of technical specification and quality standard of products, stated in the tender documents. Dealers are not acceptable for this Tender.
投標人應是滿足招標文件中所列產品技術規范和質量標準等所有要求的制造商。本次招標不予考慮代理商，
The Bidder shall provide project experience information in the past five years which complies the requirement of: I) Not less than five (5) application cases of PEA product in metro system, with the supporting documents for reference; II) There should be at least one overseas application cases (it’s acceptable that five application cases of Colombian bidders are in domestic).
投標人應提供近5年內符合以下要求的項目業績資料：I）其自動售檢票系統產品在地鐵系統中的應用案例不少于5個，并有配套證明文件供參考； II）其中至少有1個海外應用案例（哥倫比亞投標方5個應用案例可均在哥倫比亞國內）。
Consortium bid is not acceptable for this Tender.
本次招標不接受聯合體投標。
The Bidders shall not be involved in any Prohibited Practices, which include: (i) corrupt practices;(ii) fraudulent practices; (iii) coercive practices; (iv) collusive practices; (v) obstructive practices.
投標人不得參與任何禁止行為，包括：（i）腐敗行為；（ii）欺詐行為；（iii）脅迫行為；（iv）串通行為；（v）妨礙行為。
The Bidders shall not be in the penalty list of Multilateral Entity.
投標人不得出現在多邊金融機構的處罰名單中。
Should there be any Bidders fail to fulfil clause 3 requirement stated hereinabove; the Tenderer may invalidate and disqualify their participation in this process.
如有任何投標人不符合上述第3條的要求，招標人可取消其參與該投標程序的資格。
8.The Tenderer will check whether the submitted documents meet the requirement of tender document. Tender will be rejected if the following situation is found:
招標人將檢查提交的文件是否符合招標文件的要求。如果發現以下情況，投標人將被否決：
(1) Bidding documents which are incomplete or not substantially responsive.
(1) 投標文件不完整，或者沒有進行實質性響應；
(2) The bidding document is NOT MARKED as per the instruction.
(2) 投標文件未按說明進行標記。
(3) There is no authorized digital signatory and company official stamp.
(3) 無授權人數字簽名和公司公章。
(4) The validity period of offer is not according to (or shorter than) the tender request.
(4) 投標文件有效期不符合（或短于）招標文件要求的時間。
(5) Any bidder who might have submitted TWO (2) different sets of tender documents in different content of offer and NOT clarifying which one is the MAIN tender content and which one is the ALTERNATIVE.
(5) 任何投標人可能已經提交了兩（2）套不同報價內容的不同投標文件，并且沒有清楚說明主要報價和備選報價。
(6) Bidder who have quoted more than two different unit price to a specified similar product.
(6) 投標人對指定的類似產品報價超過兩個不同單價。
(7) The product and services quoted is NOT in substantial standard requested in the tender.
(7) 報價的產品和服務不符合招標文件要求的實質性標準。
(8) The Bidder didn’t submit the Bid bond according to requirements of Tender document.
(8) 投標人未按招標文件要求提交投標保證金或投標保證金不符合招標文件要求。
(9) The bidder submits the tender documents in an illegal way.
(9) 投標人以非法方式提交投標文件。
9.投標保證金
投標人須向招標人提交80萬元人民幣或等價美元的投標保證金（美元匯率使用保函開具當天匯率）。投標保證金的有效期應為截標日期起270個日歷日。在此期間，投標人不得撤回投標文件，否則招標人有權沒收投標保證金。投標保證金采用銀行保函形式，銀行保函可由招標人認可的哥倫比亞境內或中國境內的銀行開具，并符合招標人的保函格式要求，在截標日期前將原件提交給招標人。
Bidders are required to submit a bid bond of 800,000 RMB or equivalent US dollars to the Tenderer for bid security (the exchange rate of USD shall be the rate of the date issuing the security). The validity of the bid bonds shall be 270 calendar days dated from bid closing date. During this period, the Bidder shall not withdraw the bidding documents, otherwise the Tenderer shall have the right to confiscate the bid bond. The bid bond format will be accepted in the form of bank guarantee, and the bank guarantee can be drawn on a bank in China or Columbia and acceptable to the Tenderer. The guarantee shall be delivered to the Tenderer before the bid closing date.

投標保證金待開標后，在招標文件規定的期限內退還投標人。未中標投標人的投標保證金退還時間為招標人與中標人簽訂合同后的15個工作日內。中標投標人的投標保證金退還時間為雙方簽訂合同且招標方收到履約保函原件后15個工作日內。招標人退還投標人的投標保證金或履約保函均是無息的。
The bid bond shall be returned to the bidder within the time limit specified in the bidding documents after the bid opening. The bid bond of unsuccessful bidders will be refunded within 15 working days after the tender signs the contract with the winning bidder. The bid bond of the successful bidder will be refunded within 15 working days after both parties sign the contract and the tender receives the original performance guarantee. The bid bond or performance bond returned by the tender to the bidder is interest-free.
下列任一情況發生時，投標保證金將不予退還，同時，招標人將保留進一步索賠的權力：
The bid bond shall not be returned to the bidder when following cases occurs and the Tenderer keeps the right to claim:
出現下列情況時，招標人不會向投標人退還投標保證金，并保留索賠權：
(1) The Bidder withdraws or cancel the Bid viciously within the validity date;
(1) 投標人在有效期內惡意撤回或取消投標；
(2) The successful Bidder did not supply the performance guaranty before the requested deadline;
(2) 中標人未在要求的截止時間前提供履約保函；
(3) The successful Bidder did not sign the procurement contract with the Tenderer before the requested deadline.
(3) 中標人未在要求的截止時間前與招標人簽訂采購合同；
(4) The successful Bidder subcontract the project to other company without the approval from the Tenderer.
(4) 中標人未經招標人批準將項目分包至其他公司；
(5) The successful Bidder did not perform the contract after signing (force majeure excluded)
(5) 中標人在簽署合同后并未履行合同（不可抗力因素除外）；
(6) Other behaviors that against the Law of China, and the requirement of the Tender.
(6) 其他違反中國法律和招標要求的行為。
